This month we had quite an increase in Late Listing Violations. The majority resulting from not updating the listing date before bringing a Partial Save live. If you have out-of-town clients who submit documents to you via email or snail mail, be sure to save either the postdated envelope or the email — so if you receive the documents past the 2 business day time frame, you can show proof and avoid a potential fine.
Total Violations Sent = 124
Levels 1-3 Violations = 81 (allowed 2 business days to correct w/o fine)
Levels 1-3 Citations = 2 (not corrected after 2 business days so fines were issued)
Level 4 Citations = 43 (automatic fine without 2 business days to correct)
We thank and commend members for taking these violation notices seriously and updating or fixing the issue within the 2 business day grace period. The ratio of violations to citations proves that this policy is working.
Breakdown of the Violations:
Late Listings = 43 Automatic Citations
Incorrect Information = 31 Violations / 1 Citation
Wrong Area = 15 Violations / 0 Citations
Remarks = 15 Violations / 1 Citations
Branded Virtual Tours = 10 Violations / 0 Citations
Photo/Sign = 7 Violations / 0 Citations
Incorrect Status = 3 Violations / 0 Citations
Remember the goal of our compliance program is not to collect fines, but to correct the data.
We seek to ensure the MLS is a trading platform for our members with relevant, timely, accurate, and reliable data. Now that we have corrected all identified errors, we hope to see fewer and fewer violations. If you are unclear on a rule or uncertain as to procedure, please contact your NNRMLS Team.
