Days on Market (DOM)
This section is intended to provide you with information to commonly asked questions about the updates to the DOM Policy.
How does NNRMLS define DOM?
Days on Market (DOM) is the total number of days a listing is in an active, on-market status within the MLS.
When does DOM start?
DOM starts on the Listing Input Date, which is the date the listing is published in the MLS.
In Flexmls, this occurs when the listing agent clicks “Publish.”
How is DOM calculated?
DOM is calculated based on the number of days a listing remains in an active, on-market status.
Listings only accrue DOM while in the following statuses
- Active
- Active Under Contract – Show
- Active Under Contract – No Show
Listings in off-market statuses do not accrue DOM.
My listing has been withheld from MLS for two weeks while the seller was making repairs to the property. On the day I publish the listing in Flexmls, will DOM show as zero or 14?
DOM will show as zero on the day the listing is published in Flexmls.
Under the updated rule, DOM begins counting on the Listing Input Date — the date the listing is published in the MLS — not the Listing Contract Date.
Does DOM count for partial or incomplete listings?
No. DOM does not begin until the listing is published in the MLS.
Partial or incomplete listings that have not been published do not accrue DOM.

When will we switch?
The switch from Paragon to Flexmls will happen over a three week time period. The final cutover from Paragon to Flexmls is scheduled for May 19, 2025, Here are the key dates:
- April 28 – May 16: Flexmls to Run in Parallel with Paragon
- May 16 – May 18: Flexmls and Paragon Go Read-Only
- May 19: Final Cutover
Here’s a summary of what to expect:
Flexmls will launch in read-only mode on April 28, 2025. This will be the first day our members can access the new system.
Flexmls will run side-by-side with Paragon until May 16.
From April 28 – May 16, all new listings and all changes to current listings must be entered into Paragon.
From May 16 – May 18, both Flexmls and Paragon will be in read-only mode, while a final sync is performed between the two systems. During this window of time, neither system will accept changes or new listings.
On May 19, Add/Edit will go live in Flexmls, and Paragon will be accessible in read-only mode for a short period. From this day forward, you will use Flexmls to update your listings and input new listings.
Why will both systems operate simultaneously for a few weeks?
The goal of running two systems in parallel is to help facilitate a smooth migration. While we’re very excited to bring you this new system, we also realize that change is inherently challenging. Providing a window of time when our members can access both platforms will give everyone an opportunity to ease into the new system, learn about its features, and get acquainted with the way it works. The timing coincides with our training schedule as well, so that during training, you can access the platform and view your listings and contacts, Running both systems in parallel will also give our members time to verify that their personal information has been transferred from Paragon as expected, and alert Tech Support if there’s any issue.
Do I need to manually migrate my saved searches from Paragon?
MOST of your saved searches will migrate automatically. There are 2 exceptions to this, where saved searches WILL NOT transfer automatically:
- Inactive searches: Any saved searches that have been inactive for a long period of time. We are working with FBS to determine the specific length of time to be used to determine whether a search will be migrated from Paragon to the new system.
- Incompatible searches: Searches that include criteria for which there is no equivalent in the new system. While we expect that this exception will be rare, we will share additional details with members as we learn more during our implementation process.
Where can I get training?
NNRMLS will offer a range of local training options, including in-person classes, webinars, and self-paced video tutorials. We’ll also provide Brokers the opportunity to schedule custom-tailored training for their offices.
In-person training classes will be held throughout Northern Nevada. Classes are scheduled for Carson City, Gardnerville, Fallon, Fernley, Reno, and Stateline/Tahoe.
To register for a class, visit: https://calendly.com/nnrmls-live-training
Additionally, Flexmls has training built directly into the platform; From video training and guided help within the system FBS also provides ongoing webinars and a wealth of online tools and resources in the Flexmls Academy, so regardless of your level of knowledge, you can jump right in!
Is Flexmls compatible with my current IDX website?
IDX vendors provide websites for brokers and agents. These websites get listing data from NNRMLS’ servers. Along with the MLS migration, NNRMLS will begin utilizing FBS’s Spark API product for IDX feeds. This API will allow IDX providers to integrate member websites more easily and supports current real estate technology standards. While many vendors are already using the Spark API for other markets where Flexmls is available, some vendors will need to convert from the legacy RETS protocol to the SparkAPI in order to continue receiving data from NNRMLS for their IDX website customers. NNRMLS is working with these vendors directly to make sure they have all the information they need for this transition. If you or your IDX vendor has questions about this change, please email our Tech Support Team at support@nnrmls.com.
Why are we making this change now?
NNRMLS regularly reviews our software systems and evaluates alternative vendors as our service agreements come up for renewal. Many factors were considered in this evaluation process, including our current provider’s shift from the Paragon desktop version to Paragon Connect as their flagship MLS platform. FBS, the provider of Flexmls, was selected for their proven dedication to the real estate industry, delivering a reliable product backed by outstanding customer service and support.
Does Flexmls offer a mobile app? For consumers?
Yes. Flexmls offers an outstanding mobile app to members for both iPhone and Android. The Flexmls app offers a seamless user experience in that it looks and feels like the desktop version of the system, even to the extent of offering full listing-edit capabilities from your phone. Plus, you can share a version of the app with your clients, with your branding.
Does Flexmls have a client facing portal?
Yes. Flexmls includes a feature-rich client collaboration portal.
Will the products that I currently use stay the same?
While our core system is changing from Paragon to Flexmls, the other applications included in your member benefits are not changing. CRS Data, TransactionDesk, Cloud CMA, RPR, Supra, and ShowingTime are not going away.
What is going away?
Paragon and the Clareity Dashboard are being replaced.
NNRMLS will have read-only service for Paragon 5 and Paragon Connect starting on May 19, 2025. This read-only access will last for a short period.
The Clareity Single-Sign-On Dashboard, the technology behind the Member Launchpad, is being replaced with the Flex SSO Dashboard service. The targeted date for this change is May 19, 2025.
Will my contacts from Paragon transfer over to Flexmls?
Yes. Your contacts from Paragon will be imported from Paragon to the Flexmls system as part of our migration process.
What steps should I take to prepare for the upgrade?
Most of the data from your Paragon account will be automatically imported into your Flexmls account. This includes your listings, listing photos, membership information, client contacts, and most saved searches, To support you during this transition to a new MLS system, we are offering a series of dedicated training sessions that will walk you through everything you need to know—from setting up your preferences to making the most of the platform’s powerful new features. We encourage you to explore the available training opportunities and register for a class.
Will partial listings be imported into Flexmls?
No, only complete listings will be imported into Flexmls.
How can I avoid having to click “Close” on the Listing matches found pop-up?
- While it may take some getting used to, it’s not necessary to close this pop up. It will automatically close and show search results on the map whenever there are fewer than 1,000 results. As you’re adjusting the search criteria, the results are automatically updating in real time.
- If you’ve completed entering the desired search criteria and there are still more than 1,000 results, then you’ll need to click an option on this pop-up to either View List or View Map. Clicking the Close button will close the pop-up but it won’t display the search results in either the Map or List view.
- If you unintentionally click the Close button instead of one of the other two options, you can click “View Results: {number}” link in the top left corner of the Quick Search window.
How can I search for 1-level properties with no stairs inside?
- Single-level residential properties with no stairs inside can be identified in Flexmls using a combination of fields.
- First, to limit search results to single level properties, select “One” from the Levels field.
- Next, to identify properties that have no interior steps, select “No Interior Steps” from the Interior Features field.
- Optionally, you can exclude properties with basements by using the ‘not’ operator with the basement options in the Other Rooms field.
Does Flexmls have statuses for listings?
- Yes. Flexmls has statuses for listings, much like Paragon. A key difference is that some of the statuses from Paragon are technically events in Flexmls. Events are automatically associated with a listing when certain conditions are true. For instance, during the first five days following the Listing Contract Date, the tag “New” shows on the listing in Flexmls, alongside the status of Active.
- Here’s a table that shows the status names from Paragon, what those statuses are called in Flexmls, and whether they’re a status or event for the new system:

Can I increase the font size?
- There is a way to increase font size on the list view and reports built into Flex. For list view, use the +/- found on the toolbar. For reports, this can adjusted in the report editor.
- For the rest of Flex, not directly. This can be accomplished by updating your browser settings.
IDX
The Basics
What is IDX?
Internet Data Exchange (IDX), sometimes referred to as “Broker Reciprocity,” gives Participants the ability to display each other’s listings on their respective websites.
How does IDX work?
New and updated listings and listing photos are fed to your IDX Vendor via a data feed from NNRMLS, and then displayed on your company’s website. All Active, Under-Contract and recently Sold listings are included in the data feed. IDX data feeds are delivered through what is known as a RETS feed. RETS stands for Real Estate Transaction Standard. RETS requires programming to display listings on your website. This is why most members decide to hire an IDX Vendor with real estate programming expertise to develop their website.
What data will consumers see?
Active, Under-Contract, and recently Sold listing data will be available through the IDX program. The RETS IDX data field list is extensive and is available on request. The IDX display will not include confidential information intended exclusively for other real estate professionals.
Fees for IDX
How much does IDX cost?
Costs for IDX can be divided into two categories:
- The costs charged by your IDX vendor for developing, maintaining, and hosting your IDX website.
- The IDX licensing fees charged by NNRMLS. You’ll need to budget for both expenses for your website.
How much do IDX Vendors Charge?
The amount an IDX Vendor charges for its services varies widely by company and features offered. Your IDX Vendor will bill either you or your broker for its services. We recommend researching the many different IDX Vendors and products available from approved IDX Vendors to find the right match for your project. Click here for a list of approved IDX Vendors.
How much are the NNRMLS IDX Licensing Fees?
The NNRMLS IDX licensing fee is $20 per month. This fee is charged to brokers for each IDX license agreement. For agent websites, brokers have the option for NNRMLS to bill IDX fees directly to their agents. When the broker elects to use this billing option, agents are billed the monthly fee for each IDX website.
Getting Started
I’m ready to sign up for IDX. How do I get started?
Begin the process of getting an IDX Website by contracting with an IDX Vendor. Your IDX Vendor must first be registered and approved by NNRMLS. Approved IDX Vendors will be assigned credentials to the NNRMLS Vendor Portal, where they will initiate the IDX paperwork necessary to license IDX for your website. Our agreement management system will gather the required approvals and electronic signatures to complete the licensing process.
Who approves IDX for my website?
Once an IDX Agreement has been initiated by a Vendor, our system will notify your broker with an email request to review the agreement. Your broker will have the option to approve and electronically sign or reject the IDX agreement. Broker-approved agreements are forwarded to the NNRMLS IDX Team for review and approval. Our agreement management system will keep all parties updated on the agreement’s progress through email notifications.
Vendors can register new websites to your broker’s previously approved IDX Agreements. When new websites are added to approved IDX Agreements, the Website Registration requests are automatically sent to your broker for approval. MLS approval is not required for additional websites added to an already approved agreement.
How long does it take?
Getting your new IDX website up and running can take anywhere from one day to several weeks, largely dependent on your vendor’s timeline. NNRMLS will review new IDX Agreements from approved IDX vendors within three business days following your broker’s approval and electronic signature.
How does my web designer become an approved IDX vendor?
Your web designer can request to become an approved IDX vendor by clicking on the “Register for New Account” link on the NNRMLS Vendor Portal login page. Approval will be granted following a compliance review of the vendor’s products. There is no cost to become an approved vendor. Once a vendor has been approved, they will have access to the NNRMLS Vendor Portal and will be able to initiate an IDX Agreement for your project.
Managing your IDX Licenses
I’m not using my IDX website anymore, how do I cancel IDX?
Using the IDX page of the Members Website, you can quickly cancel the IDX websites. Simply log on to the member site with your NNRMLS credentials, browse to the IDX page here, and click the “Cancel” button under the options column of the IDX report.
In addition to cancelling your NNRMLS IDX license, be sure to contact your IDX Vendor to cancel services directly, as they otherwise may continue to bill you for their website fees.
I’m a broker, how do I get a list of agents in my office using IDX?
Using the Broker IDX Management page of the Members Website, you can view the IDX Websites associated with your account, including those websites belonging to agents in your office.
I’m a broker, how do I bill IDX fees to agents utilizing the data feed?
Using the Broker IDX Management page of the Members Website, you can refer to the list of IDX Agreements and select Bill to Agent on the right side of the agreement.
How do I cancel an IDX license for a website belonging to an agent in my office?
Using the Broker IDX Management page of the Members Website, you can cancel IDX Agreements and Websites associated with agents for your office.
Do I need to cancel a website for an agent who is no longer associated with my brokerage?
When an agent is terminated from your office and is no longer practicing real estate, NNRMLS will automatically cancel the agent’s website registration. If the IDX Agreement has no other active associated websites, the Agreement will also be cancelled and billing of the monthly IDX license fee will be discontinued.* When an agent who has their own IDX website transfers to another office, NNRMLS will initiate the IDX approval process for the website with the agent’s new broker. Billing activity for the agent’s website will be discontinued.
*For terminated websites and Agreements, contact your IDX Vendor to cancel services directly, as they otherwise may continue to bill you for their IDX services.
Participation in IDX
Why should I participate in IDX?
The spirit of IDX is the wide distribution and display of active and sold MLS listings to the public through Participants as a marketing effort that best serves the consumer. Allowing other participants to display your listings on the Internet is a business decision each participant must make.
IDX allows you to compete with other popular listing websites. Your website can be a premier location for consumers to view listings, learn about your brokerage, your experience, abilities, and qualifications, allowing you to successfully market your services and attract new consumers on a 24/7/365 basis.
Does IDX conflict with Nevada real estate license law/Code of Ethics?
IDX is consistent with Nevada real estate license law and the NNRMLS Rules and Regulations. IDX is consistent with the Code of Ethics since no display of other Participants’ listings can occur without their consent.
Can agents participate in IDX and have the NNRMLS database on their individual websites?
Yes, agents may have an IDX website with their Brokers’ approval. Here’s how:
- The agent’s brokerage firm must be contributing its listings to the IDX program
- The agent may use their own IDX vendor to create the IDX search engine, but only with the permission of the agent’s broker and the execution of a separate NNRMLS IDX Agreement.
- The agent’s website must prominently feature the brokerage’s branding. The brokerage’s branding must be equal to or larger than the agent’s personal branding.
- Agent IDX websites must comply with all IDX Rules and Policies.
Do I have to allow other Participants to display my listings on their websites?
Participants are free to withhold permission for display on IDX websites either on a listing-by-listing or blanket (IDX opt-out) basis. Listings excluded from the feed on an individual basis are flagged during the listing input process when the listing agent selects “Internet=No”. If you choose to completely opt-out all listings in your company, contact idx@nnrmls.com for the IDX Opt-Out form and instructions. Please note that choosing to opt-out of IDX prevents you from participating in the IDX program and featuring listings from other brokerages on your website.
What happens if I won’t allow other Participants to display my listings on their website?
If you prohibit the display of your listings by other Participants by opting-out, you may not display their listings on your website.
Will NNRMLS syndicate my listings to portals like Realtor.com if I do not participate in IDX?
Yes. Non-participation in IDX will not result in your listings being withheld from syndication. Syndication preferences are set by the Broker and are independent of IDX. However, if “Internet=No” is selected during listing input, the listing will not be fed to any websites.
What happens if someone abuses IDX?
A Participant must agree to the terms of the NNRMLS IDX Agreement prior to having the listing information appear on the Participant’s website. Displaying IDX data without an IDX agreement is a violation of NNRMLS’ IDX Rules and Regulations.
In the event of a violation of the NNRMLS IDX Rules and Regulations or a breach of the NNRMLS IDX Agreement, which is not cured within five (5) calendar days, NNRMLS may: (1) immediately terminate the NNRMLS IDX Agreement and any applicable data feed; (2) impose any fine, suspension, expulsion or other remedy applicable to a breach of the NNRMLS Rules and Regulations; and (3) pursue any and all legal remedies available by law.
Must the listing broker be identified when I display listings on my website?
Yes. The listing broker must be included on the listing body in a font that is the same color and size as the largest font used in the listing body contents. In thumbnail views of listing search results, we permit the use of the Broker Reciprocity logo in place of the listing broker, where display of the broker’s company name would not fit or be readable. In addition to this requirement, beginning September 1, 2022, IDX websites must display the listing broker’s email address or phone number as designated by the listing broker.
Can my listing information be modified when it is displayed on Participants’ websites?
No. The NNRMLS Rules and Regulations prohibit the modification of IDX data.
How do my listings get included in IDX data feeds?
All active, under contract, and recently sold listings of participating brokers will be included in the daily data feed automatically unless otherwise indicated during the listing input process. Listings can also be modified later to either add or remove a specific listing from Internet distribution.
I’m a new broker how do I opt-in?
Every Participant automatically participates in the IDX program unless an opt-out form is completed and submitted to NNRMLS.
Can I share NNRMLS listings on Social Media?
If you have an IDX website, you can post links to pages on your site to social media. If the pages on your site contain listing data belonging to other brokers, you must credit the listing broker in your post. Additionally, your post must contain your Real Estate License number. Outside of the IDX licensing framework, you must obtain permission from the listing broker prior to using their listing in your advertising content.
Clear Cooperation
What is NAR’s Clear Cooperation Policy?
Within one (1) business day of marketing a property to the public, the listing broker must submit the listing to the MLS for cooperation with other MLS participants. Public marketing includes but is not limited to, flyers displayed in windows yard signs, digital marketing on public-facing websites, brokerage website displays (including IDX and VOW), digital communications marketing (email blasts), multi-brokerage listing sharing networks, and applications available to the general public and social media sites such as Facebook and Instagram. NAR Clear Cooperation Policy | Adopted 11/19
To view/print the Listing Comparison Grid, please click here.
Why and When did NNRMLS Implement NAR’s Mandated Clear Cooperation Policy?
The National Association of REALTORS® Clear Cooperation Policy, otherwise known as “MLS Policy Statement 8.0,” was approved by NAR’s Board of Directors at its November 11, 2019 meeting. This policy aspires to ensure publicly-marketed listings are entered into the MLS so that all participants are exposed to all available listings. NAR mandated that all MLSs, like NNRMLS, implement the policy by May 1, 2020. NNRMLS was implemented on April 29, 2020.
What type of listing does clear cooperation regulate?
- While NAR’s Clear Cooperation Policy aspires to ensure publicly-marketed listings are entered into tthe MLS so that all participants are exposed to all available listings, NAR does allow for “Office Exclusive” listings as outlined on its MLS Clear Cooperation Policy website.
- At NNRMLS “Office Exclusives” are called “Withheld Listings”
- A listing entered into the NNRMLS Withheld Listing Compilation and accompanied by a completed Acknowledgement and Authorization to Withhold Listing Form meets the description of NAR’s Office Exclusive listing.
- Withheld Listings are subject to the Clear Cooperation Policy.
- As per CCP: If a Withheld Listing is publicly marketed the Listing Agent and Listing Broker have one business day to enter it as an Active Listing in the NNRMLS Paragon MLS Database.
- The penalties for non-compliance of CCP are included in NNRMLS Policy.
How did NNRMLS implement NAR’s clear cooperation policy?
- Listing Procedures were updated in the NNRMLS Policy Handbook and the Rules and Regulations Handbook.
- An Authorization and Acknowledgement Form was created to provide certification that could be signed by the seller, indicating that they do not desire the listing to be disseminated by the MLS service.
- In order to comply with Section 1.3 of the NAR model MLS rules that provide for “Exempt Listings,” some of which are known as “Office Exclusive Listings,” NNRMLS implemented the “NNRMLS Withheld Listing Compilation.”
- Withheld Listings are subject to the Clear Cooperation Policy.
- Brokers and Agents can use the Compilation to upload a “Withheld Listing.” In order to be accepted by the NNRMLS, the Withheld Listing needs to be accompanied by a fully executed Acknowledgement and Authorization to Withhold Listings Form available in TransactionDesk. Withheld Listings must be entered into the NNRMLS Withheld Listing Compilation within one business day of the Commencement Date or the sellers’ signature on the listing contract, whichever is later.
- CCP APPLIES: If a Withheld Listing is publicly marketed outside of the listing brokerage, it MUST be entered into the MLS System within ONE BUSINESS DAY of that marketing, according to the National Association of REALTORS® Clear Cooperation Policy. Please see the text of the CCP above.
What is the Withheld Listings Compilation?
- The NNRMLS Withheld Listings Compilation is a web portal where Listing Brokers and Agents will, if directed by their Seller(s), input information about their listing to be withheld and upload the Acknowledgement and Authorization to Withhold Listings Form.
- The portal can be accessed from the NNRMLS Members Website, or from a link in the MLS system.
What is the Acknowledgement and Authorization to Withhold Listing Form?
- The Acknowledgement and Authorization to Withhold Listing Form is an NNRMLS form that requires the Sellers, Listing Agent and Listing Broker to acknowledge the ramifications of withholding their listing from the MLS Database. It also requires the Sellers, Listing Agent and Listing Broker to acknowledge they understand the NNRMLS rules surrounding Withheld Listings. The form also serves as authorization from Sellers, Listing Agent and Listing Broker for NNRMLS to keep a record of the listing within the Withheld Listings Compilation. NOTE: The compilation is not searchable by members, only NNRMLS staff.
- The Acknowledgement and Authorization to Withhold Listings Form is available in TransactionDesk.
When do I use the Withheld Listings Compilation?
The Compilation can be used when:
- A required listing; Residential, Vacant Land or Multi-Family, needs to be withheld from the NNRMLS Database for reasons indicated by the seller.
- While submitting a Withheld Listing, the Compilation Portal prompts the user to also enter some information about the listing.
- The NNRMLS may use information in the Compilation for the limited purpose of responding in the affirmative or negative to inquiries from NNRMLS Members about whether or not a specific property is listed as a Withheld Listing.
- All other information provided to NNRMLS by a Listing Agent about their Withheld Listing is confidential and not made available to anyone besides certain NNRMLS employees.
- While the listing is withheld, the Listing Agent and/or Broker may only share it within their own Brokerage.
When do I use the Acknowledgement and Authorization to Withhold Listing form?
The Acknowledgement and Authorization to Withhold Listing Form must be used when:
- A listing is entered into the NNRMLS Withheld Listing Compilation. The Withheld Listing Form needs to be completed, signed by all parties and submitted to the NNRMLS Withheld Listing Compilation Portal.
Is there a Coming Soon listing status?
No. The NNRMLS suspended use of the Coming Soon listing status on May 3, 2021. See our blog for more.
Is there a form called the “Waiver of Benefits?”
No. The NNRMLS discontinued the old NNRMLS Sellers’ Waiver of Benefits the day Clear Cooperation was implemented, April 29, 2020.

Property Search
What will replace MLS Areas?
We are introducing several features that can be used as an alternative approach to location-based search.
How will the MLS System know where a property is located without the MLS Area field?
The MLS Area field isn’t used by the MLS system to determine the location of your listing. Our MLS System’s mapping technology automatically geocodes your listing in the background by auto-populating the exact latitude and longitude. These datapoints may not always be visible in the system, but they’re used in combination with other mapping tools in our MLS System. They work to help accurately position your listed property on a map for consumers to see on real estate websites and within smart phone apps.
What location-based search tools are being introduced?
To enhance property searches, we’re introducing advanced mapping capabilities and other available MLS search options. With Our MLS System’s Map Search, you can draw custom polygons to outline the locations you’d like to include in your search. You can also create Custom Map Layers which allows you to reuse the same polygon shapes anytime.
How is NNRMLS supporting its Members during the transition away from MLS Areas?
We’re providing comprehensive training, resources, and dedicated Tech Support to ease the transition.
Why are MLS Areas being phased out?
MLS Areas are being discontinued to align our property search standards with evolving technology and industry best-practices. The real estate industry and technology now rely more on GPS and digital mapping for location-based property searches.
Will I still be able to search using MLS Areas after the sunset date?
No. After the sunset of MLS Areas, the field will no longer be available for searches or listing input.
What are the benefits of the new property search features?
The new features offer advanced search customization with greater accuracy and precision, which exceed the capabilities of MLS Areas.
What alternatives are available for property searches?
Will there be training for Members after the June 18, 2024 sunset?
Who should Members contact for questions or feedback?
I use the MLS Area field to find comps. How can I pull comps without the MLS Area field?

Will NNRMLS Provide Training?
Yes. NNRMLS scheduled several in-person and virtual classes during July and August 2024 to help our members navigate the changes brought on by the Settlement Agreement. More classes will be added for the last two weeks of August. When those classes are posted, click here for those classes.
What changes will be made to the MLS System to comply with the NAR Settlement Agreement?
The Settlement Agreement requires MLSs to remove compensation fields and all compensation data from their systems. NNRMLS will remove all buyer broker compensation fields from our MLS System on August 15 ,2024. This includes the fields CommBB $ or %, CommBB Amount, Variable Rate, and Sliding Scale. All current and historical data for these fields will also be permanently deleted from the system. For more information on what changes to expect in our MLS Systems, see this NNRMLS Blog post, “Tech Changes Stemming from the NAR Settlement Agreement”.
All this Settlement Agreement information seems like a lot. What’s the bottom line?
The Settlement prohibits brokers and agents from making offers of compensation on an MLS and requires MLS members who work with buyers to enter into written agreements with their buyers.
As a member of NNRMLS, can I publish my seller’s offer of compensation to buyer brokers on a non-REALTOR MLS that isn’t subject to the requirements of the Settlement Agreement, or to an off-MLS platform where multiple brokers and agents can share compensation offers?
The Settlement Agreement’s practice changes apply to REALTOR® MLSs and non-REALTOR® MLSs who have opted-in to the Settlement. NNRMLS opted-in to the Settlement Agreement on June 13, 2024.
We are aware of non-REALTOR® MLSs that did not opt-in to the Settlement Agreement, and we also understand that third-party websites have been launched to facilitate platforms where multiple brokers and agents can communicate compensation offers.
NNRMLS members should consider the following Settlement requirements that pertain to sharing offers of compensation outside of the MLS:
- Effective August 15, 2024, NNRMLS Policy will prohibit the use of MLS data and data feeds todirectly or indirectly establish or maintain a platform of offers of compensation from multiple brokers or other buyer representatives. Violations of this policy will result in a violation with an automatic fine and will carry an additional significant consequence—the Settlement requires NNRMLS enforcement of this policy to include termination of a member’s access to MLS data and data feeds.
- By opting in to the Settlement, NNRMLS agreed that it would not create, facilitate, or support any non-MLS mechanism (including by providing listing information to an internet aggregator’s website for such purpose) for Participants, Subscribers or sellers to make offers of compensation to buyer brokers or other buyer representatives.
NNRMLS cannot support any non-MLS system for multiple brokers to share offers of compensation, as outlined above in item 2. We are not able to endorse or recommend a system for Participants, Subscribers, or sellers to make offers of compensation to buyer brokers or other buyer representatives.
We do strongly recommend that you talk to your broker if you still have questions or concerns about whether your utilization of the services provided by another MLS or a third-party website is consistent with the practice changes of the NAR Settlement Agreement.
Talk to your attorney or call the legal hotline if you are uncertain about whether legal risks may be involved with using these services as part of your marketing strategy.
If I can’t put buyer broker commissions in the MLS, how do I communicate what my seller is offering to buyer brokers?
Other than the prohibitions on using the MLS or any non-MLS mechanism where multiple brokers share compensation information, the terms of the Settlement do not limit the marketing methods you can use to advertise an offer of compensation to buyer brokers. You can communicate the offer of compensation on your own IDX website or other marketing methods, such as emails, flyers, and signs.
Updated MLS Policies prohibit using any field in the MLS to communicate offers of compensation. Members are also prohibited from using MLS data or data feeds to enable a platform for multiple brokers to share offers of compensation.
If a listing broker and seller have agreed to make an offer of compensation, the terms of the Settlement permit that listing broker to share the offer on their own IDX website. The Settlement does not allow the offer to be communicated through the MLS, or through using any non-MLS mechanism that facilitates the sharing of offers of compensation by multiple brokers.
Can I include an offer of compensation with my commercial listings in MLS?
No. While the terms of the settlement mostly apply to residential real estate, MLSs are required to completely remove and prohibit all compensation fields and data.
Can I offer a referral fee or commission in the MLS for my rental listing?
No. Though compensation practices related to rentals and property management can differ from residential for-sale practices, MLSs are required to completely remove and prohibit all compensation fields and data.
Will I be able to use the MLS System to look up the amount of compensation that was offered for a listing that was entered into the system before the settlement changes were put in place?
No. All compensation data will be removed from the MLS.
My buyer is under contract to purchase a listing that had an offer of compensation to buyer brokers in the MLS. If the purchase hasn’t been completed before the Settlement takes effect, is the listing broker still obligated to pay the commission that was published in the MLS when the purchase contract was signed?
The offers of compensation published in the MLS are binding per the MLS rules that were in effect at the time the offer was received, regardless of whether escrow closes before or after the date the settlement changes are implemented. In the event there is a dispute over this commission, NNRMLS rules require the members to arbitrate. See Section 18 of the NNRMLS Rules and Regulations for more information.
Impact on Active Listings
My seller has executed an NNRMLS Status Change Report. On that form, the seller instructed me to make an off-MLS offer of compensation following the 8/15 removal of compensation data from the MLS. If my seller receives an offer from a buyer represented by a member of NNRMLS before August 15, 2024, which offer of compensation applies?
Absent additional terms provided on a separate addendum that make changes to the current offer of compensation included with your listing agreement, the off-MLS offer in the Status Change Report doesn’t take effect until August 15, 2024. Until August 15, 2024, the offer of compensation published with your listing in the MLS is unilateral and binding.
If you and your seller agree to make changes to the offer you have published in the MLS before August 15, you must update the compensation info for your listing in the MLS. The updated Comm to BB applies to offers received after the change was made in MLS.
IDX Rules & the Settlement Agreement
Can I display offers of compensation to buyer brokers for my own listings on my own IDX website?
Yes. The terms of the Settlement allow a listing broker to communicate offers of compensation to buyer brokers on their own IDX website, for their own listings. Since all the listings in a company ultimately belong to the broker, the broker can display offers of compensation to buyer brokers on any and all IDX websites under the broker’s control, for any properties listed by that broker’s agents.
Because agents can authorize IDX websites for their licensees, these same terms apply to agent IDX websites as well. This means that an agent use their own IDX websites to communicate offers of compensation to buyer brokers for properties they have listed, as well as for properties listed by all other agents who are licensed with the same broker.
In our approach to enforcement of the related practice changes, NNRMLS will look at IDX websites for firms (main and branch offices that are grouped together) as being under the control of the same broker. The IDX website for the firm itself, along with those registered to licensees in any of the firm’s offices, can display offers of compensation for listings from any of the offices within the firm.
What is not permitted under any circumstance is the use of an IDX website to communicate offers of compensation for listings belonging to brokerages outside of the brokerage that controls the IDX website.
These same limitations apply to Virtual Office Websites (VOWs).
For more information about the Settlement and display of compensation on IDX websites, visit NAR’s Fact.REALTOR FAQ.
Can I put a link to my IDX website into the Private Remarks field?
A link that leads directly to a web page that displays an offer of compensation to buyer brokers would be a violation of the rule that prohibits using any field in the MLS to communicate offers of compensation.
A link to the home page of an IDX website, or a listing details page where offers of compensation are not displayed would be allowed.
Technology Partnership and Data Share Initiative
What is the purpose of the Technology Collaboration between NNRMLS, MetroList, and Oregon Data Share?
The purpose of the technology partnership between NNRMLS, MetroList, and Oregon Data Share is to pool resources and talent to develop software and solutions that each MLS can deliver to its own members.
Which MLSs are involved in the Technology Partnership and what regions do they serve?
NNRMLS’ partners in this collaboration are MetroList and Oregon Data Share.
MetroList is headquartered in Sacramento, and provides MLS services for Amador, Butte, Colusa, El Dorado, Merced, Nevada, Placer, Sacramento, San Joaquin, Stanislaus, Sutter, Yolo and Yuba Counties.
Oregon Data Share is an MLS that provides services for Southern and Central Oregon and the Klamath Basin.
What kind of initiatives are NNRMLS, MetroList, and Oregon Data Share working together on?
Our vision for an initial project is to launch an application where our respective memberships can access listing data from the three MLSs. This application will be a separate system from our MLS platforms, and will be accessible through our single-sign-on dashboard. Members will be able use this separate system for property searches, public records, and stats.
When will the data share application be launched?
A detailed timeframe for launching this new data share application has not yet been determined. We will provide our membership with updates on the timeline as details become available.
How will the data share initiative benefit me as a member?
This data share initiative will support your role as the trusted source of real estate expertise, providing a deeper level of information for serving clients who are moving between the states. When working with a client who is moving to or from a region served by one of the MLSs, NNRMLS members will be able to access property information in that region, providing an opportunity to deliver a higher level of service for your clients. Additionally, this initiative will strengthen each of the participating organizations, helping to control costs and increase data security.
Who will have access to the data share platform?
Access will only be provided to members of the participating MLSs: NNRMLS, MetroList, and ODS.
Does an agent in California or Oregon need a Nevada real estate license to access listing data in Nevada?
No; however, each state has its own licensing requirements for agents and brokers. In Nevada, an individual must hold a valid real estate license issued by the Nevada Real Estate Division (NRED) to legally represent a buyer or seller in a real estate transaction.
I’m a Nevada licensee, but I don’t hold a license in California or Oregon. Does this data share initiative allow me to take listings and represent buyers in the California and Oregon MLSs without having a license in those states?
No. This data share initiative does not enable an agent to circumvent a state’s real estate licensing requirements.
Am I getting a new MLS?
The technology partnership is not a new MLS. Each organization in this technology partnership will remain separate and autonomous. This partnership does not impact our ownership. NNRMLS remains a REALTOR MLS, solely owned by Sierra Nevada REALTORS. While NNRMLS is launching a new MLS platform this spring, Flexmls, the decision to move to the new MLS platform is unrelated to the technology partnership.
Will this cost me extra money?
There are no plans for additional fees related to this initiative.
Will this project change the way I list properties in NNRMLS?
No. NNRMLS members will continue to use our primary MLS system for listing input.
Will I have access to all listings in California, Oregon, and Nevada?
The initial data share project will enable access to listings from the regions served by NNRMLS, MetroList, and Oregon Data Share. While these three organizations each span large geographic areas within their respective states, the MLSs do not encompass all market regions within the states.
