What is NAR’s Clear Cooperation Policy?

Within one (1) business day of marketing a property to the public, the listing broker must submit the listing to the MLS for cooperation with other MLS participants. Public marketing includes, but is not limited to, flyers displayed in windows, yard signs, digital marketing on public facing websites, brokerage website displays (including IDX and VOW), digital communications marketing (email blasts), multi-brokerage listing sharing networks, and applications available to the general public and social media sites such as Facebook and Instagram. Why and When did NNRMLS Implement NAR’s Mandated Clear Cooperation Policy?

The National Association of REALTORS® Clear Cooperation Policy, otherwise known as “MLS Policy Statement 8.0,” was approved by NAR’s Board of Directors at its November 11, 2019 meeting. This policy aspires to ensure publicly-marketed listings are entered into the MLS so that all participants are exposed to all available listings. NAR mandated that all MLSs, like NNRMLS, implement the policy by May 1, 2020. NNRMLS implemented on April 29, 2020.

WHAT TYPE OF LISTING DOES CLEAR COOPERATION REGULATE?

  • While NAR’s Clear Cooperation Policy aspires to ensure publicly-marketed listings are entered into the MLS so that all participants are exposed to all available listings, NAR does allow for “Office Exclusive” listings as outlined on its MLS Clear Cooperation Policy website.
  • At NNRMLS “Office Exclusives” are called “Withheld Listings.” 
  • A listing entered into the NNRMLS Withheld Listing Compilation and accompanied by a completed Acknowledgement and Authorization to Withhold Listing Form meets the description of NAR’s Office Exclusive listing.
  • Withheld Listings are subject to the Clear Cooperation Policy.
  • As per CCP: If a Withheld Listing is publicly marketed the Listing Agent and Listing Broker have one business day to enter it as an Active listing in the NNRMLS Paragon MLS Database.
  • The penalties for non-compliance of CCP are included in NNRMLS Policy.

How DID NNRMLS IMPLEMENT NAR’S CLEAR COOPERATION POLICY?

  • Listing Procedures were updated in the NNRMLS Policy Handbook and the Rules and Regulations Handbook. 
  • An Authorization and Acknowledgement Form was created to provide certification that could be signed by the seller that they do not desire the listing to be disseminated by the MLS service.
  • In order to comply with Section 1.3 of the NAR model MLS rules that provide for “Exempt Listings,” some of which are known as “Office Exclusive Listings,”  NNRMLS implemented the “NNRMLS Withheld Listing Compilation.”
  • Withheld Listings are subject to the Clear Cooperation Policy.
  • Brokers and Agents can use the  Compilation to upload a “Withheld Listing.” In order to be accepted by the NNRMLS, the Withheld Listing needs to be accompanied by a fully executed Acknowledgement and Authorization to Withhold Listings Form available in TransactionDesk. Withheld Listings must be entered into the NNRMLS Withheld Listing Compilation within two business days of the Commencement Date or the sellers’ signature on the listing contract, whichever is later.
  • CCP APPLIES: If a Withheld Listing is publicly marketed outside of the listing brokerage, it MUST be entered into the MLS System within ONE DAY of that marketing, according to the National Association of REALTORS® Clear Cooperation Policy. Please see above for the text of the CCP.

What is the Withheld Listings Compilation? What is the Acknowledgement and Authorization to Withhold Listing Form?

  • The NNRMLS Withheld Listings Compilation is a web portal where Listing Brokers and Agents will, if directed by their Seller(s), input information about their listing to be withheld, and upload the Acknowledgement and Authorization to Withhold Listings Form. 
  • The portal can be accessed from the NNRMLS Members Website, or from a link in the MLS system.
  • The Acknowledgement and Authorization to Withhold Listing Form is an NNRMLS form that requires the Sellers, Listing Agent and Listing Broker to acknowledge the ramifications of withholding their listing from the MLS Database. It also requires the Sellers, Listing Agent and Listing Broker to acknowledge they understand the NNRMLS rules surrounding Withheld Listings. The form also serves as authorization from Sellers, Listing Agent and Listing Broker for NNRMLS to keep a record of the listing within the Withheld Listings Compilation. NOTE: The compilation is not searchable by members, only NNRMLS staff. 
  • The Acknowledgement and Authorization to Withhold Listings Form is available in TransactionDesk

When DO i use the Withheld Listings Compilation? When do I use the Acknowledgement and Authorization to Withhold Listing Form?

The Compilation can be used when:

  • A required listing; Residential, Vacant Land or Multi-Family, needs to be withheld from the NNRMLS Database for reasons indicated by the seller.
  • While submitting a Withheld Listing the Compilation Portal prompts the user to also enter some information about the listing.
  • The NNRMLS may use information in the Compilation for the limited purpose of responding in the affirmative or negative to inquiries from NNRMLS Members about whether or not a specific property is listed as a Withheld Listing.
  • All other information provided to NNRMLS by a Listing Agent about their Withheld Listing is confidential and not made available to anyone besides certain NNRMLS employees.
  • While the listing is withheld, the Listing Agent and/or Broker may only share it within their own Brokerage.

The Acknowledgement and Authorization to Withhold Listing Form must be used when:

  • A listing is entered into the NNRMLS Withheld Listing Compilation. The Withheld Listing Form needs to be completed, signed by all parties and submitted to the NNRMLS Withheld Listing Compilation Portal.

   

IS THERE A Coming Soon Listing Status?

No. The NNRMLS suspended use of the Coming Soon listing status on May 3, 2021. See our FAQ for more.

IS THERE A FORM CALLED THE “WAIVER OF BENEFITS?”

No. The NNRMLS discontinued the old NNRMLS Sellers’ Waiver of Benefits the day Clear Cooperation was implemented, April 29, 2020.
